Ok Update on Truck

DVFlyer replied: I am typically not a "sue 'em" type of guy, but from what we've heard, I just can't imagine this actually happening, but since it did, more power to you. I'm assuming you've had good payment history etc. You'd think they would have called and said, "hey, your check bounced can you send another". But just to come out and take the car?

They said the reason they processed so quickly was b/c of the amount..and they keep saying Felony amount.


But My lawyer called and he said my truck should be picked up tomorrow and replaced at DH's work..and that we will work out the rest..

DVFlyer replied: "Felony amount"? Sounds like a made up term. Plus, there's no way any reasonable person would think that you shouldn't have been given time to clear up the error before they took the car.

I hope you get something for your trouble. This is nuts.

actually, I repo'd a car and it turned out to be an error blush.gif so we gave it back and paid all fees etc and apologized profusely. Luckily, it wasn't just our error and the family was ok with it. As soon as they called us, I got to work checking her story and found it to be her bank's error and I kept her up to the minute all that day on my progress.

The deal was that the lady had some payment problems in the past (verged on repo) but our credit union was very lenient and would often let people ride when they were over 180 days past due. blink.gif Anyway, she sent in a payment (placing her account at 60 day's past due) and it bounced. Turned out her bank bounced the check in error. We had no way of knowing that, we only knew that the bank did not honor her payment. It was the end of the month and the loan amount would have put us over our delinquency goal for the month, so we picked up the car & charged off the loan.

Now, the finance company may have had something like that happen and if they are strict about their NSF check policy, they could have picked it up, with no questions asked. It was actually in our contract that the loan would be considered delinquent and eligible for repo when a payment was 10 day's past due.

Anyway, I read that you are getting your truck back. I'm sorry that it happend and I"m sure it was a PITA....just make sure you are blaming the right people. KWIM? Whoever screwed up needs to be doing some serious butt kissin' rolling_smile.gif
