Need your opinion on something, please!

I get home, the gym has slight fading and we knew that. Well the platform of the gym (it's a cube slide) is warped!!!! And VERYYYYYYY NOTICEABLE!!!!!!!!!!!!!!!!!! It was a bit dirty, too.
I am so upset because I spent $64 for this thing with shipping. I would not have bought it if I KNEW it was warped on the platform. It is just so noticeable that you just literally can't get past it. If I had a digital camera, I'd show you.
I've VERY new to EBAY, so I'm hoping someone can give me advice. Should I leave this woman NEGATIVE feedback? Should I email her and tell her my dissatifaction? Is there anything I can do because I feel she misrepresented the item? Any advice would be appreciated.
The sad thing is we could have bought a brand new gym cube for $99 plus shipping. It isn't the same "shape", it would be kinda octagon instead of square and we wanted square, but I feel like I paid almost the brand new price and got ripped off! The square ones are soooo hard to find, that's why I justified the price.
(P.S. I hope anyone reading this is not the seller )
MommyToAshley replied: I would email her first and tell her why you are dissapointed and give her a chance to correct the problem by maybe lowering the price and refunding some of your money, or paying for the item to be shipped back to her and refunding your money. If she does not correct the problem, then I would leave negative feedback stating that she misrepresnted the product.
Jamison'smama replied: I agree--email the person first--what was the sellers feedback rating? If it is good, then she will probably do what is right. She will not want to risk negative feedback if she sells much on eBay
maestra replied: I agree too- I've had something similar happen with some of the sellers on half.com, and they have the same kind of system with ratings. Dh and I wanted a specific UB40 cd- the import version from GB, which has more songs than the US version. We specifically bought the one labeled "IMPORT VERSION" The one they sent was not the import. When I told them the problem, they refunded the purchase price and even let me keep the cd.
You never know?!

paradisemommy replied: ITA with everyone else...negative feedback is permanent and you can't take it back once it's done so if you leave negative feedback for her, chances are you for sure won't get the problems corrected (btdt)...if she is a reputable seller than she will want to correct the problem so try contacting her first. if she doesn't respond or won't work things out with you - then leave negative feedback.
ediep replied: I agree too! I am also very new to ebay, and I always forget about the feedback, but I do know that it is permanant. Try emailing first, then if they don't correct the problem, go ahead and leave negative feedback

DH and I discussed it and decided that we want to keep it because we really can't afford a brand new one and it's not too bad. Well, I think so, but DH doesn't (of course, lol). But I wish I could get some of my $$ back. I think EBAY's policy is it's all or nothing. So it might be nothing for us. But I WILL NOT leave her feedback at all. I still just too angry about it. Even if she does say I can have a refund, we were expecting it to be a certain way.
Kirstenmumof3 replied: I agree with everyone else, but if this matter is not corrected I would contact buyer support on Ebay and let them know what happened! I have had simmilar experience with Ebay and the problem was corrected right away. Good Luck and let us know how it goes! Also when you send your complaint to Ebay support make sure you copy and paste the description of the item!

Heather replied: I hope you get some justice out of this. That is the one sucky thing about Ebay nothing is every for certain. I would leave a neutral feedback comment if you get your money back. And tell her that you are doing so...only because your item was not as described.

coasterqueen replied: Yeah, I did. She agreed to give me a partial payment back or refund my money completely. Well, if I took the refund I would have to ship it back to her which is $18 plus loose the $18 I gave her the first time to ship it! So I took the partial payment. I wanted to pursue it further, but Dh said don't bother 
I think that is what is wrong with EBAy. Yes the seller can offer the refund the money and so okay she refunds me the $45 I spent, but it costs me $36 to have it sent to me/and send it back to her and ALL because she misrepresented the item!!!!!!!!! It's a rip-off!
Dh told me this is why I should NEVER buy anything used on ebay. UGH! I bought something else used and it was exactly how the other person described it, but I guess I won't be buying anything used anymore. The thing is this woman has sold a lot and has only had 4 neg's and that was a long, long time ago. So I am confused why she would misrepresent it.
Oh well, I give up! LOL.
Schnoogly replied: Well I only buy really cheap stuff on ebay so I am not out a lot of money if it turns out badly. I did buy some diaper covers from a woman who said they had "minor tearing that did not affect the waterproofing" and they were totally torn and leaked. Oh well!
I hate when people sell stuff on ebay that wouldn't get $5 at a garage sale. It's horrible.
aspenblue1 replied: When my DH buys stuff on Ebay that he is not sure about there is some kind of insurance he gets that will refund all his money if it is not what it is supposed to be. I would still give her a negative review for misrepresented the item.
paradisemommy replied: i would see if she is willing to pick up the shipping charges..because afterall, she did represent her product wrongly and if she throws a fit..offer to pay for one of the shipping ways..that way it's only $18 down the drain..a little better than $36..nah scratch that..i'd still say she is responsible for the shipping and i'd be pissed too~

i agree with cj'smom and would file a complaint against her through e-bay because sellers should not misrepresent their stuff..that's just not right..
