For a minor's name change, there are a couple extra facts to take note of:


An adult will have to submit the petition with a reason for the change and typically a parent or a guardian will have to give his/her consent.


The reason for the change should be significant, such as adoption or bringing a stepchild into a family.


Both parents/guardians will be notified of the petition, which means an objecting parent has time to come forward.


As a result, there could be controversy over whether the child's name should be changed, and a hearing in front of a judge is more likely. Ultimately, the judge will decide what is in the best interest for the child.


Remember that changing a name is not the same as a legal adoption or the removal of parental responsibilities. If your son lives with your ex-wife and changes his last name to that of his step-father's, you are still required to pay child support.

boyohboyohboy replied: we were only able to change calebs name to my dh's after he adopted him, it was done during the same hearing, but it cost $2,000. I dont know if they will do it with out an adoption.

From what I've been reading 2 things are important in the process:
1. It has to be in the best interest of the child
2. Both living parents have to concent.

lisar replied: Its gona be hard to change her name to your maiden name. You are gona have to sweet talk a judge ALOT to get that done. Its not just you fill out paper work and its done. Especially if he was in her life to begin with, they will probably tell you no. And it cost $$$$$ big time. Here where I am in I talked to a lawyer about it and it was around 2 grand. And I also asked about adoption and that was just crazy.

mummy2girls replied: well any registry would do it. BUT unfortunetly you ahve to have the signiature of the dad too( thats if he was on the birth certificate)... if not then you wont need his sig. Call and see what the rules are with that. i want to change jennas last name when i get married. Right now its hyphened mine and Arons last name. I want to replace my last name part with Marcus's... so we will see if aron is ok with that..LOL

Kaitlin'smom replied: my sister did this a few years ago with her 2 older sons, even changed the oldest 1st name, she had to file it with the county cleark, they in turn had to send it off to the 'father' wait for approval, denial or no answer, luckly for her they only send it to his last known address, she knew he had moved several months before (but had no clue to where) so even a foward order would have taken forever to get to him in another state so she just had to waite, it actually went through pretty easy, she had already stripped him of visitation rights, he never showed up for the divorce, boy was his lawyer pissed, he was really at the time no where to be found. I think it cost her about $250. Oh then paper work off to SS to get that updated/changed with them
