I try to be nice and I get dumped on! - And checks bouncing everywhere!!!

I went straight to her job with the bad checks and she wasn't there so I left a message with one of her co-workers about what happend. I kind of thought that I shouldn't have left a message with the co-worker but then I thought who cares, she isn't caring that I'm going to be embarresed about bouncing checks. We have to meet with a personal banker tomorrow. Not only did she never pay for the dog because the checks were bad but now I'm being charged for a bunch of stuff. She's going to pay for that also. I have never had a bounced check and when we looked at the paper the lady at the bank gave us it shows that everything was fine until those checks were deposited. After that everything went downhill. What really gets me is that I've been nothing but nice to this lady and I know that she knew these checks bounced before I found out. She never even called and told me.
punkeemunkee'smom replied: Crystal I hate to tell you but held checks that bounce are not able to be turned into the DA's office as bad checks. When you take a check that is post-dated you are in essence agreeing that you know the funds are not available to you...It sucks but I learned that the hard way too. I hope your bank will help you with your NSF fees and until you get it all sorted out her bank should have a merchants line that you can call with the account # off the bottom of her check and put the amount in and see if the funds are there-as soon as they are I would get to her bank and cash as many of them as you can! Sorry you got hung out to dry on this one! What a witch!
Crystalina replied: Do you mean if she gives me a check and on one day and writes another date on the check and I deposit the check either on the date (the date she wrote on the check) or after that date I can't do anything about it if it bounces? What about business' that do that. Check cashing places for one do that. I would think that if she dates and signs the check and hands it to me then it should be honored on that day and the money should definately be in there. Am I wrong?
jacobsmama replied: That sucks Crystal! I have heard that before that if it is postdated you can't get your charges back, I found that out with my home business. But alot of times she will pay for it anyway just because they will tell her too. I hope that she just does the right thing and pays for it all like she should! But ppl these days...that is just terrible...I'm so sorry to hear that, KUP!

cameragirl21 replied: gosh, Crystal, that's awful, i really hope that you get this settled and that that woman is honest in facing up to her debt to you. i also really hope she's more responsible as a dog owner than she is in business transactions. btw, last weekend i did a shoot of a little boy with his yorkie puppy...the puppy was soooo cute, right up until he peed on his owner! Still, it was one of the cutest puppies i've ever seen.
Crystalina replied: Well, I just got off the phone with her and she claims to have a few grand in the bank and she says she'll meet us tomorrow and pay everything. I surely hope so. I don't want anything that isn't owed of course and I would never get so nasty but when I found out that my things were starting to be returned I went into panic mode because this is a small town and I don't want people thinking I write bad checks. Not only that but the business' around here put up a list of people who have returned checks! I don't want to be on that list over something like this. Most of the stuff was online stuff so I don't feel so embarresed about that (like classmates.com and other things that can be quickly taken care of.)
And Jennifer, Yorkies are the best for photos. They are stunning when prepared right. Here is a pic I took of the puppy in question the day before he went to his new home.

And I have no doubt she will be a great pet owner. I got refrences and everything and met her a few times. I'm hoping this was just a bad thing that will never happen again.
gr33n3y3z replied: I hope you have an written agreement of some kind that you sold the dog. bc you can take her to court to either get the dog back or your money. yes she gets changed also for returned checks and when it happends to businesses we add the charges to or do a billing to get the NSF back. Sorry this happend to you

punkeemunkee'smom replied: No you are not wrong in theory...the money should be there but (I have had this happen) if you take a post-dated check according to the DA (who prosecutes bounce checks) you assume the responsiblity to provde whatever the service or goods are without immediate payment...They won't take a case for you should she decide to not pay you at all like they would IF the check had been made out for the day goods/services were provided Did that make sense? I learned the hard way and now no matter how badly I would like to make a sale I will not take a post-dated check....I don't write them either-I am a firm believer that you never know what could come up and I would hate to write a check to someone and not have the $$$ there....although I would LOVE LOVE LOVE another Yorkie!!!

And Ed, we were told the same thing by the banker. She said for us to keep everything and we would be able to take her to small claims court if it came to that. It wasn't just one of her checks, that would be understandable and easily forgiven but this is every single check that she wrote me to cover the puppy. Hopefully it will all be taken care of today, like she said, and we can all move on. Like I said this is a small town and I don't want to have to have hard feelings over money. kwim? I have learned a lesson though. I trusted her so much that I even told her that she could just take the puppy and pay me when she got paid instead of making payments but she insisted on the checks. I knew where she lived because of the home visit so I trusted she would pay me. Oh well, live and learn I guess.

That way even if she won't make the fees good you won't be out the $$$ for the puppy!

Also - even IF you can't prosecute her for bad checks, that is Theft of Services by deception. And can get you in LOTS of trouble.

And either she's lying about how much is in the bank or she's just put it in. You know I even gave her the puppy half off because I was referred to her by another woman who got a puppy from me. I was being overly nice to this lady. The puppy was originally $1000 and I told her that if she were going to get him microchipped I'd give him to her for $500 which is what I did. Now I have a couple of hundred dollars on top of that for bad checks.
amynicole21 replied: As long as you can read the routing number and account number at the bottom, you can call any bank and they will tell you if the funds are there. You can claim you are a business if they ask.

cameragirl21 replied: Crystal, it's totally none of my business and please don't think i'm second guessing any of your decisions but i personally would not sell a dog to anyone who can't easily afford it at full price. Puppies are expensive, they require lots of expensive shots and medical care their first year and if they get sick as dogs certainly can, that requires even more $$$$$. I don't know if you ever go on Craig's List but i discovered it recently and i'm appalled at how many people are giving away purebred puppies and grown dogs b/c they say they can't afford to take care of them. it's disgusting, really, i can't imagine i would ever give away my cat, it'd starve before i'd say i can't afford her. also, just my suggestion but i speak from experience b/c my photography is expensive so i always get paid with checks--do not accept post dated checks...they way i see it, if they can't afford me today then they'll get me when they can afford me. there's no reason that woman couldn't have waited till she had the funds in the bank to get the puppy. again, i hope you don't think i'm second guessing your decisions or lecturing, just speaking from my own experience. you breed very cute puppies btw, i'm trying to find Scotties for a picture and there seem to be no breeders down here.

Jennifer, the only reason she got the pup without paying for it in full was because she had to have it by that Friday for her daughters birthday. The day before she went to the airport to pick up a puppy (which is so very wrong IMO, they should not fly at that age ) and the pup never showed. She had sent money Western Union and got taken for $1000 by some lady. I met with her and her DH after she was told about me by another lady. I felt bad for her and tried to help but this is not something I usually do at all. I'm a firm believer that you have to be financially able to support a dog, especially a yorkie since they are suseptible to hypoglycemia and other things. Her DH showed me the Western Union that was dated for the day before and I still believe they were being honest about that. There are many so-called "breeders" who do that. I always tell people that if you are not willing to pick the dog up from it's original home then you shouldn't take the dog. It could be a puppy mill or a hoax to get your money. This lady didn't have time to come to my house so I met her at her job. My house is always open to anyone to meet the parents and see how the dogs live.
Crystalina replied: I also wanted to touch on why she got the dog at half price. It was because I wanted her to get it microchipped. I usually do that before they leave but my vet had only 2 left and her pup did not get one. He was also 2 weeks past his "take home" date and Izabella was getting used to him and I didn't want him hanging around much longer. She was toting his furry butt around everywhere. He just had to go and if I had to lose $500 to get him gone it was no big deal to me. I still think she's a good woman and this is just a bad fluke of luck and I'm sure her daughters loving on him just like Izabella was.
