I am beyond screwed


My2Beauties wrote: OMGGGGGGGG so Brian and I are filing bankruptcy because between living in seperate households and having large amounts of bills, us trying to keep with our normaly day to day bills and the fact that I lost my job and was unemployed for 6 months and am just now getting back to work, we have decided it's best for us. It's a Chapter 7 where they eliminate your debt completely, you can keep your home and cars however.

So I have a "signature" loan through my bank and the reason I put in quotations you'll find out. This morning they come repoed my car (sp on repoed). My car payment is only 2 months behind and he has been working with me, I made a payment last month and was going to be able to completely catch up this month, however my signature loan was in default. So they come and take it and the guy stated that until my car loan, both of our signature loans as well as my bank account (negative due to fraudulent issues and was consequently closed because I couldn't get them resolved), all this totaling over $3100, I can't get my car. I said I can catch my car up those other loans and such have nothing to do with my vehicle, I am filing bankruptcy. He said they can cross-collateralize (if that's a word but that is what he used) my car with my other loans and repossess my vehicle if I am in default of other accounts and loans huh.gif I never signed anything saying I was getting a secured loan at all, it was a signature loan based on my signature dry.gif or so I thought. He said it's not spoken about but it's a rule they have at my credit union. i said so what if I had been keeping up ont hese payments but filed bankruptcy on the signature loans, what would have happened then, he said we still would have taken the vehicle. I have contacted my lawyer to find out if they can do this, from what she stated we can totally keep our cars. So now I'm car-less, I have no way to/from work. I had been speaking with this man and he was being nice and working with me until I told him about the bankruptcy. They're losing money by doing this, they won't get what my car is worth if they sale it in an auction and if I file on the car they can't come back at me for the difference in what I owe vs. sale price, they'd get more money by just giving me the darn car back and letting me pay on it. It'll be paid off in November bawling.gif I am so upset right now because I have no idea what I'm gonna do! bawling.gif sad.gif sleep.gif

so let me understand--is your car loan thru the same creditor as your signature loan? If so, then I think they can take your car.
NEVER tell creditors you are filing for bankruptcy till you have filed. They now know they will lose money with you so they're trying to take what they can.
TBH, Idk too much about bankruptcy but if you discharge everything then I imagine this is what creditors fear the most.
Before you file, you can get a new car in which you have no equity so it can't be seized. But of course you lawyer will know better than I would.
I really hope you can get some resolution, it sounds like an awful situation to be in but as a consumer, you do have rights and you need to know what they are before you let other creditors know about your pending bankruptcy.

luvbug00 replied: Ugh that stinks! I find this interesting though and here is why. Jon and his ex (not married which may be a key here) got a condo together. When they separated the condo was abandoned and left to foreclose. She filed for bankruptsy (sp) any shared payment they had then deferred to Jon. I'm not saying u should do this in ur situation but find out what claiming will or will not do for u before filing. Cuz we had to pay off hercar and we arent paying on the condo but still have to do condo fees to the tune of 350 a month. It stinks I'm paying and she's off Scott free.

coasterqueen replied: I'm confused, so you can't pay your signature loan and so they repoe'd your car? There isn't anyone that you can go to for money to help out to pay on it? I understand that getting divorce, separate households and such can be very expensive and especially not having a job. Your boyfriend can't help out? Didn't you guys just buy a brand new tv? Again, I don't claim to understand your financial status. It's too bad you don't have family that could help you so you don't lose your car, though.

I know all too well how bad filing bankruptcy is, though. It's no walk in the park. Ryan and I had to co-sign loans numerous times for his father when he got divorced and filed Chapter 7. It took him YEARS to get that cloud off his head and he would have been better off just working out deals with creditors to get things paid, than doing so -- he admits that all the time. Especially since he had to rely on his son to help him get things like a place to live (he couldn't sign himself), car loans, etc.

My2Beauties replied: Karen I did buy a tv before I knew any of this, the TV was on sale, big sale and I got it for nothin with my tax money. I hardly got nothing back on taxes, that took my whole tax check, it was less than $1000. That would not have helped me, I need over $3000 to get my car back, if I pay all that up, I risk not being allowed to file bankruptcy per my atty, because I show payment history. I have over $20,000 in debt between Brian and I and I've dug myself in such a deep hole that my minimum payments are ridiculously high. It's in our best interest to start over fresh. Karen, no I have no family that can help me, I make more money than everyone in my family, my boyfriend is a waiter lol, so no he doesn't have $3000 laying around, He pays all the bills at our house and I pay rent. Some lady just hit him a few months ago in his car, which was older so we only had liability, and so now his car is wrecked and not running and he is in the process of suing her insurance company to fix the car because they are refusing to pay even though the police report shows she was at fault, they are arguing it, as insurance companies do best! Brian's family is worse off than mine, like I said Brian and I made way more money than anyone before us and now that we've caught some hard times, we're in a bind! We have no one to bail us out.

My2Beauties replied: Oh and I wanted to add I've tried working with my creditors and they want me to settle on all these accounts for lump sums of money and I'm not able to do that, I could make payments but they won't accept nothing as payment. I'll update you guys as soon as I hear from my lawyer! Thanks everyone for your help!

I hope bankruptcy works out better for you than it has for the people I know. I hope your attorney has explained the long term consequences as well, it's not fun and if you have no family to rely on in times where you need someone, especially to co-sign a loan for some unforeseen reason, it's gonna be tough than it is now. I only tell you this because I've watched my FIL struggle for years. He thought it was the easier way out, but it wasn't. It was in the sense that the debt was gone and you don't feel like you are paying on it the rest of your life, and fortunately he had Ryan and I to lean on when he needed help with things.

My2Beauties replied: Unfortunately yes they did already take my vehicle. At karen I understand it will not be a walk in the park, believe me but at this point my hands are sort of tied. If these people were to garnish my wages, I'd be left with nothing. I'm just at a loss right now. I do know a couple people that filed, two of which went out and bought vehicles right after filing. So they were able to get a loan they just paid really high interest. I have absolutely no desire to get anymore credit cards laugh.gif The not being able to get a loan if I need one scares me, but I have not been able to get one for quite some time now due to my credit being so screwed. I tried several companies for a personal loan, signature loan something to pay all my bills off and consolidate and none of them would approve me bawling.gif
