I have now had an MRI and have a vertabra that is out of alignment and it is pushing on a cranial nerve that will require physical therapy for the next 6 weeks 3x a week to hopefully realign. If the muscle spasms do not subside soon and the nerve does not go back in place they are concerned about permanant damage and numbness. So anyway I just got a phone call from my insurance company that the car that caused the wreck doesn't have insurance and the guy who was driving doesn't have a drivers license. Niether offense was ticketed! I just called the police department to complain and was told that since the officer did not see him driving he did not HAVE to site him... Now this happened in a small town and my guess is that the officer knew the owner of the car and did not site him for that reason. I am so angry right now. We have uninsured motorist protection so the medical bills will be paid but nothing else...no gas reimbursement and no lost wages ,pain compensation or anything.....I know that it could have been worse but right now it sure doesn't feel like it!

my2monkeyboys replied: That really, really sucks!!! I'm so sorry... I think I would be raising cain to the newspapers or something about it. Surely they have to cite SOMEONE for the accident, so how could they not cite him for the lack of license and insurance?!?!?

I so did not want to wrap myself up in lawyers and all that crap but I seriously need to think about the possiblity that this can cause lasting problems for both of us. It was a 3 car accident. I was sitting still and the 2nd car drove under our truck-I watched him do it. He got hit (after he hit us...and by hit I mean tapped,litterally no damage to the back of his car AT ALL. He was 1/2 way up his hood under our truck and pushed us 10 feet when he hit us) but he claims that he got hit and pushed into our truck The guy that hit him left...hit and run and therefore is responsible under Texas state law as he was not there to defend himself. Nevermind what I say....so anyway he is the one with no insurance...it wasn't the owner of the car that was driving and that guy doesn't even have a DL in the first frickin place!

And you are right he knew the other guy and I would still drag his butt to court and also the cops If Taylor saw him driving and the other driver saw him what more proof does one need?
My2Beauties replied: FWIW and I don't know the laws where you live but my first wreck ever about 10 years ago was a hit and run and they never found the idiot. I sued my own insurance company for medical bills, pain & suffering and damage to my car, it was totaled. I paid my deductible on my car and the rest was paid I even got about $8500 settlement from them for P&S.

Check that out. Also what is your Uninsured Motorist coverage? If you had High Liability limits (say 100,000/300,000) then your UM should be the same. You wouldn't get money until all dr visits are said and done, but you'd get something. Also depends on what state you're in.....But if your liability limits are low (like here in Ohio state minimum is $12,500!! ) then likely your UM is low and yeah, you get crap.
Ask about your Medical Payments limit. It really depends on what state you're in though, some states are "PIP" states (Personal Injury or something) and yeah, I know NOTHING about all that....
