Jessica Durham was photographed allowing her toddler Michala to suck from a marijuana water pipe, also known as a bong, in 2004 by a friend upset about the activity.
"Ms. Durham allegedly remarked that smoking improved Michala's appetite and left Michala lethargic and mellow - a manner she found consistent with her own experience smoking marijuana," Judge Louis Pollak of the U.S. 9th Circuit Court of Appeals wrote in summarizing the case.
In 2005, a lower court sentenced Durham to five years in prison for unlawful marijuana distribution. She appealed both the conviction and the sentence.
In its ruling on Friday, a three-judge panel of the 9th Circuit upheld the conviction but said the sentence exceeded the applicable federal law which calls for punishment of no more than two years in prison.

I don't know if I am more disturbed by the fact that she would have gotten in more trouble (longer prison term) if she had done something to a dog instead of her child or the fact that we have caps on sentances for people who give their children drugs....

mom2my2cuties replied: I would think that child would have been removed from that situation - but then again - people from that part of the country are quite strange in thier beliefs about child raising and what is appropriate or not.
Or maybe I see that because I have been raised in the south with pretty conservative guidelines about what is acceptable behavior for parents.

I did see a television show once that showed a mom who gave her child marijuana in pill form for ADHD-it calmed him down yeah it killed his brain cells too! It was prescribed by a doc in California tho-but I still think that even for there-that is not the norm.....

You misunderstand - I wasn't meaning that at all
I meant that in the south - the beliefs on what is right and wrong tend to be VERY strict in the areas that I grew up -
I was married to someone who grew up in Spokane, WA and the things that he was exposed and that most up there considered "normal" were things that in the areas of the south I grew up in, you would have had your children taken from you in.

I did not mean to sound rude-I am in the south (Good Ol' Boy south) and I just meant that the one thing we all seem to have plenty of is ignorant people who should not have ever been allowed to reproduce in the first place But even in the land of fruits and nuts I still venture to guess that this story raised some eyebrows!

Idk, if I was from that area, I think I'd be pretty insulted by that remark.
By anyone's standards (anyone with a few brain cells left, that is), the mother's behavior was asinine.
mom2my2cuties replied: That was based on observations of people living in that area while I lived there - what thier legalities where in what they considered abuse and endangerment and just the general attitude of parenthood I picked up on while going to moms groups and talking to moms from that area.
I lived there for many years, had a child while I lived in that area and my ex husband was raised there.
I did not make that statement based on any thing except what I know to be true in that area. If someone finds that offensive then I apologize - I do not say this to offend anyone that lives there and raises children there. It was an observation based on the families I knew there and the things I noticed while dealing with the court systems there.
